General Terms and Conditions of Rental

Booking Conditions

Rental Price

The rental price includes all the services booked and stated in the contract, with the exception of the tourist tax and any additional services booked and consumed on site. The rental is granted and accepted inclusive of all charges (water, electricity, heating).

Direct booking with Agence des Alpes a. n., without intermediaries

The booking becomes firm after payment of a 25% deposit and implies acceptance of the general rental terms and conditions. Cancellation insurance may be taken out at the time of booking.

Once the deposit has been paid, Agence des Alpes a. n. reserves the right to accept or refuse certain modification requests from the tenant (dates, type of apartment, place of stay, services, etc.). If modification requests are accepted, the tenant will be liable for “modification fees” corresponding to the actual administrative costs incurred, with a minimum of €15 if special processing is required.

If the booking is made more than 30 days before the start of the stay, the client must pay Agence des Alpes a. n. a deposit equal to 25% of the rental amount.

If the booking is made less than 30 days before the arrival date, the client must pay the total amount of the stay.

If the booking is made less than 7 days before arrival, only remote payment by credit card will be accepted.

Balance of the rental  only for direct bookings

The balance must be paid to Agence des Alpes a. n. one month before the arrival date. (Decree No. 2005-1315 of 21/10/06).

Flexible cancellation only for direct bookings

Any cancellation of a booking must be confirmed to Agence des Alpes a. n. in writing.

If the client has not taken out the cancellation insurance offered by Agence des Alpes a. n., or if the reason for cancellation is not covered by the guarantees of the insurance taken out with Agence des Alpes a. n., the cancellation fees are as follows:

  • Cancellation more than 60 days before the start of the stay: no charge;

  • Cancellation between 59 and 30 days before the start of the stay: 25% of the amount of the booked services;

  • Cancellation less than 29 days before the start of the stay and up to the arrival date: 100% of the amount of the booked services.

 

Agence des Alpes a. n. reserves the right to recover the amount by all legal means.

In case of force majeure as defined by Article 1218 of the French Civil Code (natural disaster, pandemic, etc.), the cancellation conditions will be adapted according to the circumstances.

If the client has taken out cancellation insurance, they will be reimbursed the full amount of the booked services under the conditions specified below in Article IV.

Any early departure by the tenant will not give rise to any refund.

In case of cancellation or interruption of the stay, the administrative fees, the amount of the cancellation insurance, and all fixed charges and services consumed and/or booked will remain payable to Agence des Alpes a. n.

Payment by bank transfer only for direct bookings and if payment by credit card is impossible

Bank charges remain the responsibility of the ordering party.

Considering the time required to process a bank transfer and to maintain the reservation option until receipt of funds, the client is requested to send by email a copy of the transfer order within 48 hours of its execution.

Terms of occupation of rented property / security deposit

 

For all furnished rentals, a security deposit is required upon key handover.

The deposit ranges from €500 to €2000 depending on the type of accommodation. It must be provided in the form of a pre-authorization on a credit card. The pre-authorization will be cancelled within 14 days, except in cases where compensation must be withheld for the reasons described below.

The deposit will not be cashed unless compensation must be withheld to cover costs related to repairs for any damage and/or deterioration caused, replacement at new value of lost, destroyed, damaged and/or missing items, or payment for cleaning services not performed (…). If applicable, after notification, the tenant undertakes to pay Agence des Alpes a. n. compensation corresponding to the cost of repairs or restoration of the accommodation. In case the deposit is insufficient to cover these costs, the tenant must pay Agence des Alpes a. n. the balance within eight days of receiving the relevant invoice(s).

The tenant must behave responsibly and ensure proper maintenance of the premises.

If the tenant chooses to do the cleaning themselves, the premises must be returned in good condition and cleanliness upon departure (dishes cleaned and put away, garbage emptied and taken out, premises cleaned with household products, fireplaces emptied and cleaned, blankets and belongings put away, etc.). If the tenant opts for the cleaning package or if it is included, the premises must be left with dishes cleaned and put away, garbage emptied and taken out, fireplaces emptied of ashes, blankets and belongings put away, etc.

Otherwise, the cleaning and/or tidying service will be charged and deducted from the deposit at the current rates.

The tenant undertakes to use the rented premises with care. They are liable for any damage caused intentionally, negligently or accidentally by themselves, their accompanying persons or visitors during the contract period in the premises they exclusively occupy.

The tenant must comply with the condominium regulations as well as any internal regulations of the building where the apartment is located, so that neither the apartment owner nor Agence des Alpes a. n. are ever disturbed or inconvenienced.

The tenant must respect: energy saving instructions, especially avoiding leaving windows and radiators open unnecessarily, take all precautions against frost risk, and comply with the obligation to maintain quiet after 10 p.m., according to Article R. 1336-5 of the Public Health Code and in general all applicable regulations on French territory.

Before departure, the tenant must return all furniture items to their original places as found on arrival.

Any lost key will result in changing the door lock cylinder and invoicing the actual costs to the tenant.

If the rented property is also for sale, the tenant authorizes the negotiator of Agence des Alpes a. n. to show the premises. Except with specific agreement from the tenant, visits may only take place on working days between 10 a.m. and 6 p.m. with a minimum 24-hour prior notice.

The tenant authorizes Agence des Alpes a. n. to carry out any urgent repairs during the stay without entitlement to rent reduction or compensation for inconvenience caused.

The tenant authorizes without rent reduction or compensation: intervention by the property management (syndic) if necessary, technical interruptions in the operation of the building’s General Services (heating, hot and cold water, electricity…), and interventions by Public Services (water pipes, electricity, telephone, access…).

Holiday Rental Insurance

The tenant must be insured against rental risks, theft, fire, water damage, either by an extension of their main residence insurance or by any other special insurance covering holiday stays. All personal belongings or effects belonging to the tenant are their sole responsibility. They are in no way covered by any insurance policy issued by the building, the owner-lessor, or the agency acting as intermediary.

Cancellation or Interruption Insurance, Civil Liability, and Rescue and Repatriation Costs  only for direct bookings

Agence des Alpes a. n. offers an optional insurance called LOCPLUS which can be subscribed to at the time of booking (see current rates).

Insurance brokerage company SAM, SAS under French law, capital €100,000, registered with the Nanterre trade register under number 523 543 445.

This insurance covers, under certain conditions, the risks listed below, detailed in the LOCPLUS general conditions, which alone govern the insurance if subscribed by the tenant. The LOCPLUS general conditions are provided to the tenant at booking and are available on the Agence des Alpes a. n. website.

  • In case of cancellation: The insurer guarantees reimbursement to the insured of deposits and balance paid in case of cancellation within the limits and exclusions set forth in the LOCPLUS general conditions.

  • In case of interruption of stay: The insurer guarantees reimbursement to the insured of the unused rent resulting from interruption of stay caused by one of the events listed in the LOCPLUS general conditions, up to €25,000. Compensation is prorated based on the number of occupants and the remaining days of the stay.

  • Rescue and repatriation costs: During the stay, the insurer covers costs of search and rescue operations by an authorized organization to assist the insured. In case of interruption due to a covered health accident, the insurer covers unplanned transport costs incurred for the insured and other tenants, within the limits of the LOCPLUS general conditions.

  • Tenant’s civil liability for material damages (fire, water damage, storms originating on the premises, damages caused to movable and immovable property, etc.): the insurer covers tenant liability within the limits of the LOCPLUS general conditions.

  • Epidemic / pandemic extension: Coverage extends to cancellations, interruptions, and late arrivals due to COVID-19 or any epidemic or pandemic recognized by national or international health authorities, including health accidents of the tenant, death of the tenant or close relative, positive test within 7 days before the stay, and refusal of boarding by carrier justified by excessive temperature subject to testing within 48 hours.

    • If the insured cannot travel: insurer covers all unused and non-refundable guaranteed services.

    • If the insured can travel: insurer covers unused and non-refundable guaranteed services between the original departure day and actual arrival day. (Full details in LOCPLUS general conditions, section 6.1.6.)

By subscribing to this optional insurance, the tenant acknowledges having read the LOCPLUS general conditions, of which the above is only a brief extract.

Arrival / Departure

  • Arrival: Key handover is from 5 p.m. at the earliest. Check-in formalities can be completed during opening hours.

  • Late arrival: In case of late or out-of-hours arrival, it is essential to notify reception before closing at +33 (0)4 79 00 65 34. A late arrival procedure will then be communicated to the tenant for taking possession of the accommodation and completing formalities. If the tenant encounters difficulties or is unable to collect keys via the provided procedure, Agence des Alpes a. n. cannot be held liable and no compensation will be granted.

  • Upon arrival, the tenant agrees to pay the tourist tax, any outstanding services and supplements, and to provide the security deposit.

  • The rental period is understood from 5 p.m. on the arrival day until 10 a.m. on the departure day. Late departures (after 10 a.m.) may be charged as an additional day.

 

Inventory and Condition Report

  • An inventory and condition report is carried out at each tenant’s arrival and departure.

  • Any complaints regarding cleanliness must be reported immediately upon entry.

  • Any remarks or discrepancies regarding the condition or inventory must be reported by the tenant within 24 hours of key collection.

Departure: The accommodation must be vacated and keys returned no later than 10 a.m. on the last day of the rental.

The tenant agrees to inform Agence des Alpes a. n. of any damage or defects caused during the stay before departure.

 

Miscellaneous

The accommodation is rented for the maximum number of persons specified in the contract. This number may under no circumstances be exceeded. Babies and young children are considered full occupants on the same basis as adults. In case of violation, an “over-occupancy penalty” will be charged for indivisible weekly periods starting from the contractual arrival date. The amount will be based on the published rate, prorated by the number of persons in over-occupancy, with a minimum charge of €150 per person in over-occupancy.

In certain accommodations, pets are not allowed by the owners. If you bring pets, please ensure prior to booking that they are permitted in the accommodation chosen. A flat fee of €25 per domestic animal will then be charged.

The rental description specifies whether bed linen is included. For hygiene reasons, the use of sheets is mandatory. Subject to availability, bed linen may be reserved from Agence des Alpes a. n. as an additional service.

For any disputes relating to the execution of the rental contract, the tenant, if a “consumer” within the meaning of the introductory article of the Consumer Code, is informed that they may refer to the consumer mediator either electronically at www.anm-conso.com or by postal mail addressed to ANM Conso, 2 Rue de Colmar – 94300 VINCENNES.

Domicile Election

For the application of these terms and their consequences, the parties elect domicile at their respective addresses stated herein or, failing that, at their respective registered offices.

Partial Invalidity

The nullity or unenforceability of any provision of this contract shall not affect the validity of the other provisions which shall remain fully effective. However, the parties may mutually agree to replace the invalidated provision(s).

Data Processing

Pursuant to Article 28 of the GDPR, these providers are bound by strict confidentiality clauses prohibiting any use of the data entrusted to them beyond the contract and requiring implementation of technical and organizational measures that meet security and data protection requirements.

Purpose of processing: The legal basis for collecting and processing your personal data is the execution of the contract (Article 6.1.b GDPR), compliance with a legal obligation (Article 6.1.c GDPR), and legitimate interest (Article 6.1.f GDPR). The purposes are contract management, order processing, delivery and invoicing, accounting including client account management and relationship follow-up, client management operations, prospecting activities (technical prospecting operations including data normalization, enrichment, and deduplication), selection of persons for loyalty, prospecting, survey, product testing, and promotional activities, preparation of commercial statistics and client knowledge development in relation to our subcontractors (Office de Tourisme des Menuires et de Saint-Martin-de-Belleville and Arkiane).

Data collected: For the purposes described above, the collected data include identity (title, name, first names, address, telephone numbers, fax, email addresses, date of birth, internal client ID), payment data (bank or postal account details, check number, credit card number and expiry date), transaction data (transaction number, details of purchase or service subscribed), family, economic and financial situation (number and age of children, presence of pets), billing information (payment methods, discounts granted, receipts, balances and arrears), and data for prospecting and promotional activities.

Data recipients: Your personal data recipients include our management teams and partners and subcontractors (Office de Tourisme des Menuires et de Saint-Martin-de-Belleville and Arkiane). The Office de Tourisme sends non-commercial communications by email to animate the client relationship on behalf of our organization (news, events, practical stay information).

In accordance with applicable law, you may object to receiving these messages at any time during initial contact or by clicking the unsubscribe link in each message. You have the right to access, rectify, and delete your data. Access requests may be made by simple letter with ID copy to the Office de Tourisme des Menuires, Immeuble Belledonne | La Croisette 73440 Les Menuires or by email to dpo@lesmenuires.com.

Retention period: Personal data related to clients collected for the purposes above are kept for five years from the end of the commercial relationship. Data establishing proof of rights or contracts or kept for legal obligations may be archived longer, per applicable law (Commercial Code, Civil Code, Consumer Code). Personal data of non-client prospects may be kept for three years from collection or last contact (e.g., request for documentation).

Rights of access and opposition: Under Articles 38, 39 & 40 of the French Data Protection Act (January 1978), you have the right to access, rectify, and delete your personal data. Requests must be sent by simple letter with ID copy to Agence des Alpes a. n., 1269 avenue de la Croisette 73440 LES MENUIRES – info@agencedesalpes.com.

In some cases, refusal to provide necessary information may prevent client registration, contract execution, and thus the client may have to renounce the contract. Your data may be used for commercial communications (email or SMS) by Agence des Alpes a. n. about similar products or services you acquired or subscribed to. You may consent or object to such communications at data collection and subsequently via an unsubscribe link in each message.
